Hire Terms and Conditions
Please read these terms carefully before making a booking.
1. Bookings and Payments
- 50% of the total value of the booking (inclusive of equipment hire value, bond and delivery fee) must be paid via credit card (a 2% merchant fee applies) or direct deposit to secure the hire. The booking remains unsecured until the initial payment is received.
- The remaining balance is due 5 days prior to delivery of the equipment. If the balance is not received in full, Tumble Tots Party Hire may refuse to deliver or allow use of the equipment, and the hirer forfeits all payments up to the equipment hire value plus a 10% administrative fee.
- Bonds are refunded following equipment return in the same condition and cleanliness in which it was hired out (normal wear and tear excepted), on the Thursday following the hire date, in the same manner in which the bond was paid.
- If hired equipment becomes unavailable due to damage or theft, comparable and similar equipment may be substituted. If substitution is not possible, a full refund is issued. Tumble Tots Party Hire accepts no further liability for inability to provide equipment.
2. Delivery and Collection of Equipment
- A pre-arranged date and time for delivery and pickup will be agreed between the hirer and Tumble Tots Party Hire. The hirer grants the right to enter the property at the street address specified.
- Delivery and collection times may change as Tumble Tots Party Hire deems necessary to accommodate other hires. Confirmation is provided via email no later than 2 days before the hire date.
- It is the hirer's sole responsibility to ensure the delivery address provided is correct. If the address is incorrect, or the hirer is not present within 10 minutes of the scheduled delivery time, delivery may be refused and all payments forfeited.
- Setup and/or breakdown services are separate from delivery: $70 if prepaid during booking, or $85 if arranged on the event day (deducted from the bond).
- A late pickup fee equivalent to one (1) day's hire of the respective equipment applies, charged daily, if equipment is not available for pickup at the scheduled time.
- The hirer must ensure suitable access to and from the site. A high-risk delivery fee of $180 applies where access is inadequate, including venues with more than 10 undeclared stairs and no alternative entry.
- For parks and open spaces, the hirer is responsible for arranging vehicle access with local government or facility management. If access is not arranged and the setup area exceeds 50m from the delivery vehicle, offloading/setup may be refused and all payments forfeited.
- Tumble Tots Party Hire is not liable for any loss or damages should it be unable to deliver due to accident or misfortune; a full refund is issued in this case.
3. Use of Equipment
- Other than as required by law, Tumble Tots Party Hire makes no representation and gives no warranty regarding equipment usability or functionality.
- It is the sole responsibility of the hirer to ensure the equipment hired is suitable for the age and skills of the children using it, and to examine the equipment prior to use.
- The equipment must only be used for its intended use and in accordance with the product information sheet(s) provided.
- The hirer must ensure that all children using the equipment are supervised by a competent person at all times.
- All equipment supplied on hire remains the property of Tumble Tots Party Hire. The hirer must not sublease, rent, sell, or remove the equipment from the delivery address.
- The hirer is responsible for the equipment until it is collected or returned, and must maintain it in good condition (reasonable wear and tear excepted).
- A cleaning fee of $50 per hour applies where equipment is returned in an unacceptable condition; the bond may be retained in part or full to cover cleaning costs.
4. Theft or Damage to Equipment
- Tumble Tots Party Hire is not liable for any loss or damages arising out of misuse or abuse of the equipment by the hirer, and the hirer indemnifies Tumble Tots Party Hire accordingly.
- In the event of undesirable weather conditions, it is the hirer's responsibility to ensure adequate, safe coverage of the equipment to prevent damage.
- It is the hirer's responsibility to ensure the equipment is secure at all times, including providing security if stored in unlocked premises.
- For damage, the hirer pays all costs associated with replacing the equipment plus a 6% administration fee, or all repair costs plus a 6% administration fee (if deemed repairable). Damage examples include: vinyl tears, food or face-paint stains, rain or direct sunlight damage, structural damage from incorrect or malicious use, and EVA mat damage from high heels, chairs or tent pegs.
- Tumble Tots Party Hire will notify the hirer in writing within 72 hours of the hire period of any claim of damages. The bond may be retained to cover costs; damage costs exceeding the bond are invoiced separately and due within 7 days of receipt.
- The hirer must immediately notify Tumble Tots Party Hire of any theft and is responsible for all replacement costs. Tumble Tots Party Hire has no obligation to provide replacement equipment.
5. Cancellations
- Cancellation terms apply once a booking has been accepted (by accepting the written quote provided). Cancellations must be made in writing, via email.
- Equipment value $450 or under: cancellation more than 14 days prior to the hire date receives a full refund; within 14 days, all payments are forfeited.
- Equipment value $450 or over: cancellation more than 25 days prior receives a full refund; 15–25 days prior, 50% of the equipment hire value plus a $20 administration fee is payable; within 14 days, the total equipment hire value is due.
- During periods of severe weather (electrical storms, high winds, flooding etc.), Tumble Tots Party Hire reserves the right to cancel a booking with all monies refunded, and accepts no liability for such cancellations. If the hirer cancels due to poor weather, standard cancellation terms apply.
- For active bookings subject to a postponement agreement (including government restrictions, illness or other agreed reasons), no further cancellations will be accepted and all monies will be forfeited.
6. Liability and Indemnity
- Tumble Tots Party Hire is only liable to the hirer to the extent permitted by law. The hirer acknowledges and accepts that persons using the equipment can be injured.
- Tumble Tots Party Hire is not liable for injuries or damages arising out of the hire and use of the equipment, late delivery, inadequate space for safe use, or the hirer ordering incorrect or insufficient equipment or using it outside its specifications.
- The hirer indemnifies Tumble Tots Party Hire against any liability to any third party who suffers injury, loss or damage caused wholly or partly as a consequence of any negligent act or omission, or failure to ensure safe use, storage, erection or transport of the equipment.
7. Privacy
- Tumble Tots Party Hire respects the hirer's privacy and complies with the Privacy Act 1988 (Cth). Personal information provided for the supply of equipment will be dealt with pursuant to the privacy laws.
